The Castro Precedent: the High Court opens the door to employee class actions against employers
Complicated calculation – no longer an excuse.
In a precedent decision the High Court of Justice overturned the National Labor Court’s decision in regard to Castro employees’ motion to certify a class action against Castro. While the National Labor Court rejected the motion in part, on the ground that it would require complicated calculations, the High Court determined that this inherent challenge should not be a barrier for employees from class action proceedings. Implications may be far-reaching.
