Court Ruling: Journalistic “Follow-Up” Coverage Using Photos Constitutes Fair Use
The Jerusalem Magistrate’s Court dismissed a copyright infringement and moral rights claim filed by a British photographer against the Israeli Public Broadcasting Corporation (“KAN”).
KAN was represented by Adv. Eran Presenti, partner and head of the Intellectual Property practice at our firm, who argued that the publication constituted legitimate journalistic “follow-up” coverage to the original report in the Daily Mail. The use of the photos was limited, proportionate, and protected under the Copyright Law as “fair use” for the purpose of news reporting.
The court ruled that the use qualified as “fair use” within the context of news reporting.
The claim was dismissed in full, and the photographer was ordered to pay KAN legal costs in the amount of NIS 45,000.
