In its efforts to cope with the Corona pandemic, the Government has approved legislation which has far-reaching implications on the subject of privacy.
And so, on March 16, 2020, the government approved Interim Emergency Regulations (Empowering the General Security Service (Shabak) to Assist the National Effort to Reduce the Spread of the New Coronavirus), 5780-1920, authorizing the Shabak to acquire, collate and process technological information to monitor a patient who has been diagnosed in the 14 days prior to going into quaratine or being hospitalized, in order to identify all those who were within the range of the infection, across the entire range of the patient’s movements. Those found within the range of the infection will be updated directly by phone .
In addition and in parallel, the government has also approved Interim Emergency Regulations (Location Details) 5780-2020 which authorize a police officer, without a warrant, to obtain details of a patient’s location as well as the location of anyone suspected of being a patient who is on the database of a telecom carrier, in order to warn the public or a specific person, in order to prevent or reduce the spread of the Coronavirus. In general, it is also possible to acquire location data of a person who is required to be in quarantine in order to monitor their compliance with the quarantine directives.
