Class Action Motion Against Kal Gav Dismissed – Petitioner Ordered to Pay Costs
A motion for class certification was filed against Kal Gav Ltd., claiming that the support bar profile of a school backpack sold by the company has a sharp edge that could potentially cause injury. An expert opinion by an engineer was attached to the motion, asserting that the product is defective and dangerous.
The court questioned how the claim of a “certain injury” aligns with the fact that no actual injury cases were presented—not even involving the petitioner or her son—despite the company having sold approximately 140,000 such products.
The judge also noted the similarity between the petitioner’s last name and that of the attorney representing her, without any disclosure of a familial relationship.
Kal-Gav submitted a response and a motion for summary dismissal, represented by Adv. Ronit Sutton Salkind, Partner and Head of the Class Actions Practice, and Adv. Maayan Ziv-Glanz, Partner in the Litigation and Class Actions Department. The company argued that the petitioner lacks individual standing, that no defined group of harmed individuals was identified in the petition, and that the familial relationship between the petitioner and her attorney—who are married—was not disclosed.
The court ruled that, due to the substantial procedural flaws in the motion, the proceeding could not be concluded without compensating the company. Accordingly, the motion was dismissed, and the petitioner was ordered to pay NIS 30,000 in legal costs.
